What these terms cover

These terms apply to the Constant Card app and the MILK website. By using Constant Card you're agreeing to them. If you don't agree, don't use the app — and if you've already joined, you can delete your account at any time from the Account screen.

Cafés using MILK's business software do so under a separate written agreement. These terms don't replace it.

Who provides what

That means if a café changes its rewards, closes, or stops using MILK, the programme changes with it. We'll keep the app running, but we can't make a café honour a reward, and we don't provide the coffee.

Your account

• Your account is yours — one person, one account. Don't share your login.
• Keep your password to yourself. If you think someone else has it, change it.
• Give us an email address you actually use, or you'll lose access to your card if you change phones.
• You must be at least 13 to hold a Constant Card account.

Stamps, points and rewards

• Stamps and points are earned by buying things at a participating café and having your card scanned. They're recorded at the till.
• They have no cash value. They can't be exchanged for money, sold, or transferred to someone else.
• They belong to the café that issued them and only work at that café.
• A café can change its programme — the reward, the number of stamps, the tiers — and can end the programme entirely. Where a change takes away something you've already earned, we'll ask the café to give reasonable notice through the app.
• Deals and rewards may have an expiry date or conditions. Those are shown on the deal itself.

If something goes wrong at the counter

If a stamp doesn't land or a reward won't scan, talk to the café first — they can add it manually. If it's the app misbehaving rather than the café, email hello@milkpos.com.nz.

Fair use

Don't try to game the programme. Specifically: don't create multiple accounts to farm rewards, don't claim stamps for purchases you didn't make, and don't try to break into, overload, or reverse-engineer the app.

If you do, the café or MILK may suspend or close your account and cancel unredeemed stamps or points.

Notifications

If you allow notifications, the café can send you deals and reward reminders. You can turn them off in your phone's settings at any time, and your card will keep working exactly as before. See the Privacy Policy for what we do with your information.

Closing your account

You can delete your account at any time from Account → Delete my account. It's immediate and it can't be undone — you'll lose any stamps and points you've built up. The Privacy Policy sets out exactly what's erased and what the café keeps in anonymised form.

We may close an account that breaches these terms, or if we stop offering Constant Card. If we're shutting the service down, we'll give reasonable notice so you can use what you've earned.

The app itself

We work hard to keep Constant Card available and accurate, but we can't promise it will never be down, and we can't promise it will be free of faults. We may change or update it, and we may add or remove features.

Constant Card is free to use for customers.

Liability

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those apply to you as a consumer.

Beyond those rights, and to the extent the law allows: we're not liable for indirect or consequential loss, and our total liability to you is limited to the amount you've paid us for Constant Card — which, since the app is free to customers, will usually be nothing. Rewards are a matter between you and the café.

Changes to these terms

We may update these terms. If we do, we'll change the date at the top of this page, and we'll tell you in the app if the change is significant. Continuing to use Constant Card after that means you accept the updated terms.

Law

These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction over any dispute.
